法律语境下的汉代文学——以汉赋为例

摘　　要：汉赋以"通过文学的法律"和"作为法律的文学"的形式,对汉代的立法、司法、执法通过铺陈进行了充分的表现。汉赋中表现的法律精神和法律理想主要有:支持天罚神断、天人合一的思想;借助鬼神追求绝对公平的愿望;提倡德主刑辅的精神等。赋作家在作品中建构出盛世图景,表达其政治理想,推动了礼法制度的改善和进步。This paper analyzes legislation, justice and law enforcement from two aspects： ＂law through literature＂ and ＂literature as law＂. Han Fu embodies the spirit and the idea of law. It is showed by the following points： the theory that man is an integral part of nature; the wishes to pursue absolute justice with the aid of supernatural be-ings ; and the spirit of ruling of morality with penalty as assistance. Writers express their feelings in literature work, and in return, their works will create a feedback loop to the society,
