浅谈职务犯罪侦查中的初查

摘　　要：初查是检察机关根据侦查职务犯罪案件的特殊性,在立案之前所设立的一个十分重要的环节,已被我国各级检察机关的自侦部门广泛应用。检察机关受理的职务犯罪案件线索材料,往往真伪难辨,所反映的问题有的详实,有的简单,如果不经过认真细致的初查,很难对案件线索有一个准确判断。初查既是立案前提,又是立案后侦查工作甚至整个诉讼活动基础,关系整个案件的成败。Being an important step before filing a case, the preliminary investigation system is estab- lished according to specific characteristic of duty crime that is investigated by prosecutorial organizations, which has been used extensively in self - investigation departments of Chinese prosecutorial organizations at all levels. Clues and materials of duty crime accepted by the prosecutorial organizations cannot be distinguished between real and false, and some of the reflected matters are full and accurate and some of them are not comprehensive. If there is no careful preliminary investigation, it is difficult to judge clues of the case exactly. Preliminary investigation is not only the precondition for filing a case, but also the foundation for the investigation after filing the case and the whole lawsuits, which is a matter of success or failure of the whole case.
