完善流浪儿童民事诉讼代理人制度的构想

摘　　要：流浪儿童民事诉讼代理人的现实缺位导致流浪儿童权益不能得到有效的保护,完善流浪儿童的诉讼代理人制度是解决这个问题的关键,建议修改《民事诉讼法》第57条,使流浪儿童诉讼代理人与流浪儿童的监护人分离,应当建立流浪儿童的公法诉讼代理人制度,该公法诉讼代理人由区、县的民政局承担,建议在民政局内设"流浪儿童权益保护委员会"作为流浪儿童的公法民事诉讼代理人。法律应当就"流浪儿童权益保护委员会"介入流浪儿童民事诉讼案件的条件、代理的权限、诉讼中的权利、义务和责任等进行明确的规定。Rights and interests of street children can not be effectively protected because of realistic absence of institution of street children＇s civil litigation agents.The key to this problem is to perfect the system of civil litigation agents for street children.It is suggested that article 57 of ＂Civil Procedure Law＂ should be modified.To empanel street children＇s litigation agents and to empanel street children＇s guardians should be separated.Public civil litigation agent system for street children should be set up.Civil affairs bureaus of districts can act as public civil litigation agents.＂Street children＇s Rights Protection Committee＂ should set up in Civil Affairs Bureau,the Committee is the public civil litigation agent for street children.The conditions by which ＂Street Children＇s Rights Protection Committee＂ is involved in should stipulated by law;and the agent authority and the obligations and the responsibilities of ＂Street Children＇s Rights Protection Committee＂ in proceedings should be the provision of law.
