摘 要:在《物权法》第28条的适用中,我国有些法院将内容上仅为确认一方当事人协助办理登记、移转不动产物权之债务的判决,视为该条所称的"法律文书"。这种误解不但侵害了权利人的物权,还危害到第三人的交易安全。在理论上需澄清,只有能够直接变动物权的法律文书,即,只有人民法院的形成判决或仲裁委员会具有形成力的仲裁裁决书才能直接引起物权变动。根据我国现行民法规范体系,这样的法律文书依其所涉事项可具体化为几个类型。建议最高人民法院通过司法解释对此予以明确。As to application of Article 28 of the Real Right Law, some of the Chinese courts considered a judgment, the decision of which only confirmed that one party has the obligation to assist to record the real right of a realty in the realty register and alienate it to the other party, as the legal document mentioned in Article 25. This misconception will not only violate the real right of the right holder, but also endanger the transaction security in market. So it' s necessary to make it clear in theory that only the legal document, which can directly lead to change of real right, in other words, only the documents with creative effect of the people' s court or arbitration committee can directly result in change of real right. Based on the current norm system of the Chinese civil law, such legal documents can be divided into some types. Our supreme court shall enumerate such legal document in form of a judicial interpretation.
