论虚假诉讼行为的定罪

摘　　要：新民事诉讼法修正案用两个条款规定了虚假诉讼行为。当务之急是对民诉法修正案的两个相关条款作出司法解释,以规范惩治虚假诉讼犯罪的司法实践,结束同事不同罚的混乱局面。目前应当适用刑法第307条和第313条分别以帮助伪造证据罪或拒不执行判决裁定罪来对虚假诉讼行为定罪量刑,同时构成其他犯罪的,择一重罪处罚。False lawsuits have appeared for a long time,and become more and more in recent years.Scholars and practioners have different views.though academic achievement is more than any period before.Mainstream opinion has not been into being.Amendment to Law of Civil Procedure 2012 mentions it,and gives a stage conclusion,in the same time leaves a piece of blank to fill.The best plan is to add a new article in the penal code in the future.But urgent affairs is to give a judicial expound to the Amendment that is relation to false lawsuit,so that directing the practice of punishing false lawsuit crime and finishing the situation of different names of crime and penalty distributed to the same kind of crime.Before the new criminal law appearing,we should sentence false lawsuit crime according to Article 307 and Article 313 of penal code,if composing other crime,choosing the most important one to sentence.
