摘　　要：备用信用证从其起源，到其发展，都与独立担保制度以及信用证制度紧密联系。可以说，备用信用证是以信用证的形式发挥着独立担保的功能。因此，在制定备用信用证的法律规范时，可以借鉴独立担保制度在司法实践中反映出的问题，或参照信用证制度的基本原则和特殊诉讼程序。Standby letter of credit has a very close relationship with letter of credit and independent guarantee in its emergence and development. It can be said that standby L/C functions as L/C to provide independent guarantee. Therefore, when making laws about standby L/C, the legal problems of independent guarantee in judicial practice can be taken into account, and the principles and specific procedures in litigation of L/C can be consulted.
