摘　　要：元代以后由于法制的沦丧,加剧了社会政治的腐败黑暗。明清时期民众对法制社会的渴望和呼唤,通过文人创作的小说反映出来。这些作品对公平公正、惩恶除暴、清官执法、守法护法等方面的理想探索,彰显出明清法制题材小说的特有的思想价值和护法精神。owing to the loss of the legal system after the Yuan Dynasty, the corruption and viciousness in society were exacerbated. The public＇s craving and calling for the legal society were reflected in the novels by men of letters. The exploration of the ideal society is included in the works of fairness and justice, the punishment of evil, the elimination of violence, the enforcement of law by the honest and upright officials, as well as the observance and the defense of the law. They highlighted the unique ideological value and the upholding constitution spirit in the legal novels of the Ming and the Qing Dynasties.
