摘　　要：德国20世纪70年代中期,由医师公会建立了全国医疗纠纷调解和鉴定组织,调解医师受到患者的医疗纠纷投诉。虽然德国医疗纠纷发生率较高,但是其免费的鉴定或调解机制有效地化解了医疗纠纷。由于保险公司承担赔偿费用,其调解或鉴定的中立性有待提高。The mediation and identification organizations for medical negligence claims were founded in middle 1970s by the German Medical Association（Bundesarztekammer）.The mediation and identification organizations can resolve the medical negligence claims effectively,though the rate of medical negligence claims in Germany is higher than many developed countries.Because of the damage paid by insurance company,the fairness and neutrality of mediation and identification should enhance.
