摘　　要：集体协商代表权的问题是决定集体协商成效的基础性问题,现实生活中已逐渐凸显因集体协商代表权相关法律制度的欠缺而导致的诸多协商困境。因此,有必要理顺代表权产生的法理基础,重新构建代表权法律制度,解决因代表权而产生的异议与纠纷。The right to representation is a basic issue of collective consultation system.In China,the deficiency of legal system of the right to representation caused a lot of difficulties in collective consultation.Therefore,it is necessary to build up legal system of the right to representation on the basis of legal principles so as to resolve the disputes related.
