摘　　要：民族文化公益林被排除在公益林补偿法律之外,这是公益林补偿法律的漏洞,基于民族文化公益林补偿的必要性和可能性,中国应该建构民族文化公益林补偿法律机制。民族文化公益林补偿法律机制的建构是一个复杂而系统的工程,本文仅对民族文化公益林补偿的主体、形式和立法体例提出了一些肤浅的建议。National culture public welfare forest was left out of the public welfare forest compensation regulations,but this is the public welfare forest compensation regulations loophole,based on the necessity and the possibility of public welfare forest compensation,China should construct national culture public welfare forest compensation legal mechanism.National culture public welfare forest compensation legal system construction is a complicated and systematic project,this article is only for the main body of public welfare forest compensation legislation style,form,and three aspects put forward some superficial suggestiones.
