摘　　要：庭审前律师的辩护权是刑事辩护制度的重要组成部分。庭审前律师辩护权有其理论基础,同时国外立法和实践都有相关的完善规定。我国通过借鉴有益的相关经验于2012年对《刑事诉讼法》进行大的修改,对律师庭审前辩护权的立法有突破性的修改和完善。At the pretrial period, the lawyer＇s defense right is an important part of the system of criminal defense. It has the theoretical foundation. And the foreign legislation and practice also have complete relevant provisions. There is a breakthrough to revise and improve of the legislation of lawyer＇s defense right at the pretrial period by drawing lessons from the beneficial experience on the“Criminal Procedure Law” in 2012 in China.
