摘 要:我国现行的仲裁裁决承认与执行制度存在着分类用语十分混乱、不予执行理由不适当及仲裁裁决承认或执行异议程序不合理方面的诸多弊端,应在更广泛地参考更多国家或地区立法最新实践及学者们研究成果的基础上结合我国的实际情况予以矫正,包括:应使用七个分类用语并确切地予以界定,对纯内地裁决仅应保留可仲裁性和违反公共政策这两项不予执行的理由,废除针对涉外仲裁裁决和外国仲裁裁决的不予执行司法审查裁定前的内部报告等制度。Current recognition and enforcement systems of arbitral awards in China have many drawbacks such as very confused classification terminology, inappropriate reasons {or the refusal of enforcement, and unreasonable procedures of voicing an objection to recogni- tion or enforcement of arbitral awards. Therefore, China should rectify the drawbacks abovementioned on the basis of combining the latest legislative practice of more nations and academic achievements as a frame of reference with actual situation. China should exactly de- fine the recognition and enforcement systems of arbitral awards by using seven classification terminologies, only retain two reasons for the refusal of enforcement with regard to pure ma- inland awards, namely arbitrability and the violation of public policy, and repeal systems like internal report before the determination of refusing to enforce judicial review rules concerning foreign arbitral awards.
