摘  要:担保的本质即保障债权的实现、担保人仅就系于债务人的特定法律事实的发生而根据债权人的要求承担担保责任。第三人类型担保人法律地位平等,不同类型的共同担保在法律适用上应该互通。共同抵押法律规则应当参照《物权法》第176条的精神予以确立:约定优先;在没有约定的情形下,债权人应当先针对债务人提供的抵押物行使该抵押权,债权人对债务人外的第三人提供的抵押物享有选择权,且第三人类型抵押人之间法律地位相互独立、互不影响。The essence of guarantee is ensuring the enforcement of creditor' s rights. Guarantor has to undertake the security responsibilities according to the requirements of the creditors, only when the specific legal facts happened , which are from the debtors. The third person type guarantors have equal legal status, there is no difference in the rules of various joint guarantee. Applicable rules to joint mortgage can be established by the spirit of article 176 of Property Right Law: agreements are first; without contracts, all the mo mortgagors rtgaged the creditor shall claim his mortgage right on mortgaged property of the debtor, when property provided by the third party, the creditor can enjoy the option, and the are independent, each other is not affected.
