摘 要:美国历史上长期以来在公众场所执行死刑,大众直接自由观看。1936年以后,死刑只能在监狱执行,但是,允许特定的死刑执行见证人观看。1996年至今,有14个州和联邦允许电视直播死刑执行过程。死刑执行的过程向公众公开违背了基本的人权和人道,应当禁止。但是,可以从死刑犯的利益出发,允许医生、神职人员、心理学家、甚至于亲属作为临终关怀者观看死刑执行。For a long time, the United States of America had conducted the death penalty in public places and every citizen could watch the whole executing process freely and directly. Until 1936, the death penalty could only be executed in the prisons, and specific witnesses had been allowed to watch the execution of death penalty. Since 1996, the federal government and 14 states have legally permitted to telecast the execution of death penalty live. The paper argues that the live telecasting of death penalty execution shall be prohibited be- cause it goes against the basic human rights and humanity. However, for the sake of the condemned prisoners, it is acceptable to allow doctors, clergy, psychologists and even relatives as a hospice to observe the execution.
