论残疾人的信息无障碍权

摘　　要：残疾人的信息无障碍权,就是指残疾人平等地、方便地、无障碍地获取、接受和传递信息的权利,包括传统的文字提示(如字幕)、盲文、手语、语音等信息交流服务无障碍权,电子和信息技术无障碍权,网络无障碍权等内容,对于残疾人享有其他人权具有至关重要的意义。残疾人信息无障碍权属于国际公约确认的人权,属于人权中需要国家积极作为的社会权。残疾人信息无障碍权对应的义务主体是国家,国家应承担尊重、保护和实现残疾人信息无障碍权的义务。我国应通过立法、行政执法、司法三方面加强对残疾人信息无障碍权的国家保护,同时社会组织和企业也应当承担具有道德义务性质的社会责任。The barrier-free fight of information of the disabled means that the disabled have the fight to receive and share information equally, conveniently and barrier-freely, including barrier-free fight for information communication service like the traditional verbal directions （such as title） , braille, sign language and voice;barrier-free fight for electronics and information technology ; barrier-free fight for network, etc, which is of great significance for the disabled to enjoy other fights. The barfier-free fight of information of the disabled is a fight confirmed by the international convention;is a human right required of the state＇ s positive action. The corresponding obligation subject for the barrier-free fight of information of the disabled is the country, who has the responsibility to respect, protect and realize this fight. Our country should strengthen the state protection of the fight through legislation, administrative enforcement and judicature. At the same time, social organizations and enterprises should also bear the social responsibility with moral obligations.
