摘　　要：在介绍经医疗输血或使用血液制品而感染艾滋病病毒问题的重要性和紧迫性、既往案件的赔付情况及国外的经验的基础上,阐述了"无过错"责任原则和"补偿"的概念,并提出医疗输血所致HIV感染的保险和补偿机制的伦理原则,包括公正原则、责任原则、相称原则、尊重原则、包容原则、应急优先原则、共济原则,以及建立医疗输血或使用血液制品感染HIV的保险和补偿机制,包括保险、基金会或补偿基金、国家补偿等;说明了经医疗输血或者使用血液制品感染HIV补偿的程序,以及补偿内容、补偿办法、补偿金额等;并提出建立经医疗输血或使用血液制品感染HIV补偿问题协调机制。同时,阐述了对若干问题的建议。In this paper, the authors introduced the importance and urgency of the case of being infected with HIV by medical blood transfusion or blood products using, the compensation of previous cases and the foreign expe- riences, then described the principle of ＂unerringness＂ and the concept of ＂compensation＂. The ethical principles including justice principle, the responsibility principle, the proportion principle, the respect principle, the toler- ance principle, emergency priority principle and the mutual aid principle, and the insurance and compensation sys- tem including insurance, foundation or compensation fund, national compensation, etc. were proposed for the HIV infection caused by medical blood transfusion or blood products using. After this, the compensation procedures, compensation content, compensation measures, compensation amount, the coordination mechanism and some ad- vices were put forward and explained.
