摘　　要：随着配子捐赠助孕技术的发展,配子供求失衡,配子商业化及后代近亲婚配,配子及后代的法律地位等一系列医学、伦理及法律问题逐渐突显出来,并可能遭遇特殊受赠者(如HIV/AIDS患者)的伦理困惑。对此应该实施医疗策略,如冷冻卵子建立卵子库;应加大宣传力度,提供政策支持,使更多的人了解、接受并支持捐赠行为,使潜在的捐赠人群加入到捐赠队伍中。同时,应不断加强伦理监管并建立和完善相关法律法规,使我国配子捐赠助孕逐步走向良性发展之路。With the rapid development of gamete donation technology, some related medical ethical and legal problems have come out, such as imbalance of supply and demand, gamete commercialization, consanguineous marriage in offsprings, legal status of offsprings and so forth, and may cause ethical confusion in some special done such as HIV/AIDS patients. According to this, medical strategies should be implemented, such as frozen eggs to establish ovum; should enhance propaganda in the society, provide policy support to enable more people to under- stand, accept and support the donation behavior, make the potential donations to join the team. At the same time, ethical supervision should be strengthened and establish then perfect the relevant laws and regulations, make gam- ete donation to gradually on the benign development way.
