民族地区农村老龄化与权益保障制度研究——基于“土地换保障”的视角

摘　　要：农地与社保之间缺少转换制度是目前农村土地流转中的主要问题。劳动力外流已使东北朝鲜族农村原本十分缺乏的社会保障资源进一步流失,而留守老年人出租土地,又使大部分土地收益被承包户所有,造成土地保障功能日益弱化。"土地换保障"是一种制度创新,利用土地收益来置换社会保障,有利于保护老年人和流动人口的生存权和发展权,进而实现从"土地保障"到"社会保障"、从"家庭分散经营"到"适度规模化经营"的社会转型。The lack of transformation system between rural land and its protection of rights and in- terests is the main problem in rural land circulation at present. Labor force outflow has contributed to the further drainage of social protection resources which are very scarce in the Korean - inhabit- ed northeast rural areas. The contractors gain the profits of land from the aged people who rent their land to them, which weakens the protection of rights and interests of the aged. The exchange of land for social security, a kind of system innovation, making the most of land profits to ex- change social security, can help safeguard both the rural aged people and the right of existence and development for the flowing population and realize the social transformation from land protec- tion to social security, from decentralized operation of families to moderate- scaled management.
