论死刑案件的证明标准

摘　　要：2010年7月生效的由最高人民法院等五部门联合下发的《关于办理死刑案件审查判断证据若干问题的规定》为死刑案件确立了较之普通刑事案件更为严格的证明标准,这是由死刑案件的特殊性所决定的,这里的死刑案件应该是指最终宣判死刑立即执行的案件。死刑案件的证明标准既是死刑案件定罪的标准,也是死刑案件量刑的标准。由该《规定》所确立的死刑案件证明标准已是一种定格的证明标准,这一标准的适用不会造成普通刑事案件办案质量的下降。Provisions on Several issues Concerning the Examination and Judgment of Evidence in Handling Death Penalty Cases ,jointly issued by the Supreme People＇ s court and other five ministries, took effect in July, 2010. Due to the special nature of death penalty cases,the Provisions has established a stricter standard for the examina- tion and judgment of evidence concerning death penalty cases than ordinary criminal cases. The death penalty cases here refer to cases with the final sentence of immediate execution. The standard is not only the standard for criminal conviction but also the standard for measurement of penalty. The standard set by the Provision has been established and its application will not reduce the quality in handling ordinary criminal cases.
