转型期宅基地使用权流转之法理分析

摘　　要：研究目的:以宅基地使用权的私权属性为出发点,农民理性的嬗变为研究视角,探讨宅基地使用权制度改革的取向。研究方法:文献资料法、综合分析法。研究结果:在经济社会发生转型时,现行宅基地使用权制度安排引发的宅基地扩张与闲置、社会保障属性与资产属性等诸多矛盾,亟需改革。就宅基地使用权本质而言,应是带有公权色彩的私权。现行的制度设计是以农民理性的欠缺为逻辑起点的。事实上,农民是理性的经济人,经受了社会转型带来的种种冲击和考验的农民已经开始由生存理性向发展理性嬗变,赋予农民处分宅基地的充分自主权乃是物权立法的使命。研究结论:在不损及公共利益的前提下扩张宅基地使用权的自由空间,赋予其流转的自由。实现权利自由与限制的适度平衡应是该制度改革的价值取向。The purpose of the paper is to probe into the orientation of reform on the rural residential land use right system from the perspectives of the civil property nature of the rural residential land and the possible evolution of farmers’ rationality.Methods used include literature review and comprehensive analysis.The results indicate that the existing institutional arrangements of the rural residential land use right system may lead to conflicts such as the urban expansion but idling use,functions between social security and capital assets during the economic social transition period.Therefore the reform is in urgent.For the rural residential land use right in essence,it should be a civil right with the elements of public power.Current system design is based on the lack of rationality of farmers at the logical starting point.In fact,farmers are actually rational.They have been impacted and tested by the social transformation and would become more and more rational regarding development rather than survivals.It is the mission of property rights legislation to give farmers the full autonomy of disposing the rural residential land.The conclusion is that we should expand the freedom of rural residential land without harming public interest and permit the free circulation.The balance between freedom and restriction could be pursued during the reform of the system.
