摘 要:程序监督人是为保护弱势群体和公共利益,由人民法院依职权决定或经利害关系人申请许可而介入诉讼活动的,该制度的建立依据诉讼监督的法理理念,改变了原被告对垒争讼二元化传统诉讼模式,构筑了"三足鼎立"的诉讼格局。通过诉讼监督主体的特定性、诉讼目的公益性和监督权力的有限性等诸多法律维度的考察,我国应当建立一种区别于两大法系之外的、独特的、适合我国需要的程序监督人制度。该制度能够借助公权监督,保护弱势诉讼群体,维护社会公共利益,使其不受非法侵害以及受到侵害时能得到及时有效的法律救济,以便修复民事诉讼监督不力的缺憾,凸现民事诉讼法律制度的公平正义。The practice of proceeding superintendent is a judicial action either adopted by the people's court or requested by the party involved and approved for the purpose of protecting the vulnerable group and public interests, which,out of the concept of judicial supervision,formulates a suit pattern of "three pillars" that has replaced the traditional dualistic party pattern. With a review of many legal latitudes of special proceeding superintendent,public interest of suit and limitation of supervising power, the paper suggests that a unique proceeding superintendent system should be established in China which distinguishes itself from the other two legal systems to suit its concrete conditions which could supervise public power, protect weak class and safeguard public interests. And once infringed upon, the interests of the weak and the public could be timely remedied, thus vigorous supervision of civil suits could be exercised and fairness and justice enhanced.
