论教育教学权的法律保障

摘　　要：教师的教育教学权是法律赋予教师不同于普通公民的特殊权利,教师的社会地位主要是通过教师享有的权利来体现的。在当前教师教育教学权大量被侵犯的背景下,应建立和完善教师聘任制度,明确侵犯教师教育教学权的法律责任以及教师的教育教学权相关规定,并完善教师申诉制度,切实保障教师的合法权利。Teachers＇ rights of education and teaching are the special rights issued to them by the law, which are different from average citizen＇s general rights. Currently, with the background in which teachers＇ rights of education and teaching have been much violated, we should establish and perfect the system for the appointment of teachers. We should make clear the regulations as well as the legal responsibilities of violating teachers＇ rights of education and teaching. Further more, we should perfect appealing system for teachers. Only in this way can we protect teachers＇ legal rights.
