民事诉讼请求范围之类案监督研究

摘　　要：人民法院的裁判是否超越当事人的诉讼请求范围,是检察院抗诉的重点监督内容。在对突袭性裁判的检察监督中,检察院既有许多成功的抗诉案例,又不可避免和人民法院存在认识上的分歧。检察院要提高对越界裁判的抗诉质量,应当进行有效的类案研究,总结抗诉经验教训,准确界定民事诉讼请求的内涵,明确民事诉讼请求的刚性界限和柔性界限。It is a significant clement in judicial inspection for a procuratorate to examine whether a judicial judgment is made beyond the scope of claims made by a complaint. In practice, there arc successful judicial inspections, but in some cases the procuratorate and the court are holding different opinions. To promote its judicial inspections, the procuratorate should study similar eases effectively to extract lessons and experiences, to define claims in civil actions and to define the scope of the claims.
