农村公益性墓地选址问题的法理学思考——兼论传统民间法与现代法的互动

摘　　要：在现代法制化的进程中,传统文化、民族习俗与现代法律的互动问题不容忽视。本文从农村公益性墓地选址问题的角度切入分析这一问题,在详细阐述相关概念的基础上论述了农村公益性墓地最佳选址的重要意义以及在这一过程中传统文化民族习惯与现代法制化过程的互动过程。最后,作者通过对云南安宁市农村公益性墓地选址的具体分析进一步具体论证了传统文化民族习俗与现代法制化互动过程中各方利益平衡的原则和方法。In the process of modern legal system, interaction problem among traditional culture, national customs and modern legal can not be ignored. This paper from the perspective on countryside public cemetery site selection analyzes this problem, in detail discusses the significance of tile best location related on the basis of the concept of rural public cemetery and in the process of traditional culture ethnic customs and modern legal process of the interactive process. Finally, based on the specific analysis of rural public cemetery location of Anning county in Yunnan, the author further specificly demonstrates the traditional culture national customs and modern legal system in the process of interaction between the interests balance principle and method.
