文献遗产:“档案”的嬗变与发展——《档案法》向《文献遗产法》转型的思考

摘　　要：《中华人民共和国非物质文化遗产法》的正式施行,标志着我国"文化遗产"概念的范畴包括物质文化遗产(主要为文物)和非物质文化遗产两部分组成。文献遗产作为文化遗产的一种重要且特殊的组成部分,我们对其关注仍然不够。应以"档案"概念为基础,在学理上明确"文献遗产"概念的内涵和外延,并对其进行专项立法保护。可以考虑利用修改《档案法》的机会,推动《档案法》向《文献遗产法》的转型,实现国家对各类文化遗产保护工作的无缝衔接。The law of the People＇s Republic of intangible cultural heritage has been carried out formally, this marked that the category of ＂the cultural heritage＂ include the concept of tangible cultural heritage （mainly for the cultural relics） and tangible cultural heritage in our country. The documentary heritage is an important and special cultural heritage; We still not pay enough attention to it. The author thinks that, with the concept of ＂archives＂, based on clear in scientific theory ＂documents heritage＂ concept con- notation and extation, and carries on the special legislation protect, and has a certain feasibility. We can use the opportunity of changing the archives law to advance the archives law to the documentary heritage law transformation, realizes to the protection to all kinds of cultural heritage.
