论外国海事仲裁裁决在中国的承认与执行

摘　　要：基于海事仲裁的特殊性,外国海事仲裁裁决在中国申请承认与执行时,其在管辖的法院、执行保全措施、实质执行以及拒绝承认和执行等方面均不同于一般外国商事仲裁裁决,也与外资非正常撤离的仲裁裁决的执行有所不同。作为外国海事仲裁裁决承认与执行的申请人,不仅要了解中国针对外国商事仲裁裁决的审查标准和依据,还必须掌握海事仲裁裁决承认与执行的特殊性,只有这样,方能实现其裁决债权,更好的保障自身的合法权益。Because of the specific characteristics of maritime arbitration, while applying for enforcement and recognition, for- eign maritime arbitral award differs from ordinary foreign commercial arbitral award in many ways such as jurisdiction, en- forcement security, actual execution and refusal to recognize and enforce. Foreign maritime arbitral award also distinguishes itself from the arbitral award for international investment. In order to obtain his arbitration rights and better protect his rights and interests, the applying party for enforcement and recognition of foreign maritime arbitral award should learn more than the standard which the court may use for ordinary commercial arbitral award and grasp the specific rules used for reviewing the foreign maritime arbitral award.
