摘　　要：农村宅基地使用权指农村村民依法享有的,在集体所有的土地上建造、保有住宅及附属设施的权利。现阶段我国农村宅基地使用权制度仍然存在着法律规范较少、效力层次低、社会实用性差以及法律规范之间相互冲突等缺陷,要建立完善的农村宅基地使用权法律制度除了沿用已取得的成就外,还必须加强立法,化解现有法律制度的相冲突的局面。The right to use the rural residential land means that rural villagers are legally entitled to construct and retain the right of residential and ancillary facilities on collective land. At present, our rural residential land use right system still has some defects such poor legal norms, ineffectiveness, poor social practices and conflicting rules. It is quite necessary to strengthen leg- islation and resolve the conflicts in existing legal systems in order to establish and improve the rural residential rights legal sys- tem.
