摘 要:对高校权力运行的制约是权力运行的内在要求,也是高校各利益相关者的需求。从现有的高校权力运行制约相关规章制度及其实践来看,我国高校现行的权力运行制约主要有分权制约、制度制约、权利制约等制约模式;相关规章与规范的建制不完备、低效或无效,导致了权力制约的非制度化运行。今后,高校权力运行制约应在国家的法律框架内,保障党委核心领导地位的前提下,建立差异决策、优势互补的权力制约格局;健全以章治校、程序正当的制度制约体系;探索利益相关者多元参与的权利制约途径;塑造规范有序、和谐共荣的权力制约文化。The restriction of powers in universities is the internal needs from power operation and stakeholders of universities. On the basis of investigation of existing relevant regulations and practices of power restriction in our universities, we found that there have been three main power restriction models, including decentralization restriction, institutions restriction, and rights operating of because of the deficiency, inefficiency of relevant restriction, however, which are non-institutional regulations. Therefore, we came to the conclusion that we should pay much attention to the followings: ①to establish a power restricting structure of different decision bylaws, making and complementary advantages, ②to complete an institution restricting system of constitution and③to probe a right restricting approach of stakeholders' diverse participation,④to shape a restriction culture of harmony and normalizations.
