摘  要:目的:了解护生对《侵权责任法》有关医疗损害诉讼的基本规定、护理侵权概念及护理侵权行为的认知情况。方法:对2011年6月-2012年4月实习的护生进行问卷调查。结果:护生对医疗侵权诉讼的举证、最重要的证据、特定免责的情形、推定过错情形、赔偿主体、全额赔偿的认知率分别为:40.40%、73.60%、61.20%、46.80%、26.00%、43.20%。对护理侵权概念完全正确认知率为27.14%。对护理侵权行为认知率分别为:技术侵权29.60%、伦理侵权58.80%、产品侵权77.20%、管理侵权68.15%。结论:护生对《侵权责任法》有关医疗损害诉讼的基本规定、护理侵权概念及护理侵权行为认知率较低,应加强护生《侵权责任法》护理侵权核心内容的培训、教育。Objective:Cognition of nursing students about "Tort Law of the People's Republic of China" the relevant provisions of the basic medical malpractice litigation, nursing tort concept and nursing care of tort. Methods : Survey among nursing students, who practiced in our hospital from June 2011 to April 2012, was performed by questionnaires. Results:The Cognition rate of nursing students about the medical tort litigation of burden of proof, the most important evidence, a specific exemption cases, presumption of fault conditions, subject of compensation, full compensation was 40. 40% ,73.60% ,61.20% ,46. 8% ,26. 00% ,43.20% respectively. The cognition rate of nursing tort concept completely correct was 27.14%. The cognition rate of technical infringement, ethics violations, product tort, administration tort was 29. 60%, 58. 80%, 77. 20%, 68.15% respectively. Conclusions: The Cognition rate of nursing students about "Tort Law of the People's Republic of China" relevant provisions of basic medical malpractice litigati nursing students ; nursing tort; core contenton, nursing tort concept and nursing tort is low. We should strengthen training nursing students about the "Tort Law of the People's Republic of China" core content of nursing.
