摘　　要：监狱执法自由裁量权是监狱执法权的重要组成部分,它的行使是依法治监的难点问题。明确监狱执法自由裁量权的概念、分类及其存在的合理性和被滥用的可能性,以及不正确行使自由裁量权的表现形式对于监狱执法十分重要。控制监狱执法自由裁量权是依法治监、依法行政、建设社会主义法治监狱的必然要求。The prison law enforcement discretion is an important part of the prison law enforcement power,its exercise is the difficulty of supervision according to the law.Control of the prison law enforcement discretion is the inevitable requirement of supervision according to the law,administration according to law,the construction of the socialist rule of law.Control of the discretion has the following strategies：legal control,program control,internal control,power control,judicial control and main control.
