摘 要:立法机关通过修改民事诉讼法建立起公益诉讼机制,明确了公益诉讼受案范围和主体资格。立法机关在平衡公共利益保护与公益诉权滥用的价值冲突时秉持审慎态度,在《民事诉讼法》第55条将公益诉讼原告资格限定为"法律规定的机关和有关组织",而将众多民间非政府组织和公民个体排斥在外。民事诉讼法未明确规定检察机关的公益诉讼原告资格,除法律明确授权的以外,检察机关不应当违反法律规定直接提起公益诉讼,但可以通过督促起诉、支持起诉等形式参与公益诉讼。By amending the Civil Procedure Law, the legislature established a public interest litigation mechanism, and defined the scope of the case and the main qualifications of public interest litigation. In the balance of value conflict between public interest protection and public interest litigation right abusing, the legislature adopts a prudent attitude. In article 55th of the Civil Procedure Law the plaintiff qualification in public interest litigation is limited to authorities regulated by law and relevant organizations, and many non-governmental organizations and individual citizens are excluded. In Code of Civil Procedure the procuratorial organs are not regulated explicitly with plaintiff qualification of public interest litigation, except as expressly authorized by law. The procuratorial organs should not directly file public interest litigation by violating the law, but they can supervise the prosecution, support prosecution and participate in public interest litigation in other forms.
