摘　　要：农村工业污染日益严重,污染事故频发,而损害赔偿有效救济不足,农民人身权、财产权难以保障。基于生存权与发展权平等理论,提出农村环境责任保险以切实保障农民权利。运用多学科交叉的理论分析方法,诠释农村环境责任保险的内涵,理论结合实际阐述其实施必要性。从农村工业企业投保内部动力不足与环境责任追究制度不完善及乡镇政府环境管理失灵等三方面分析农村环境责任保险实施之困境,并提出农村环境责任保险实施的有效策略,包括提高农村工业企业的环境风险意识与环保责任意识、健全针对农村工业企业的环境污染损害赔偿制度与责任追究制度、明确农村环境责任保险制度的强制性与政策性及加强乡镇政府、保险公司与金融机构的三方合作等,以切实保护农民的合法权利,保障农村社会的稳定与持续发展。Industrial pollution in rural areas is becoming increasingly serious are frequent pollution accidents appeared. However, effective remedies of damages are insufficient, and personal rights and property rights of farmers are able to shield. Based on the theory of equality of right to life and the right to development, this paper proposes rural environmental liability insurance to protect farmers＇ rights effectively. Using the multidisciplinary theoretical analysis, this paper interprets the meaning of the rural environmental liability insurance and sets forth the importance of integrating theory with practice. From the three aspects of less motivation to cover insurance of industrial enterprises, in sufficient the environmental daty-charging system, and the failure enviromnental administration in rural governments, this paper analyzes the plight of implementing rural environmental liability insurance, and proposes effective strategies for implementing environmental liability insurance in rural areas. The strategies include improving the rural industrial enterprises environmental risk consciousness and awareness of environmental responsibility, improving environmental pollution damage compensation system and accountability system for the rural industrial enterprises, ascertaining the mandatory policy of the rural environment liability insurance system and strengthening tripartite cooperation of township government, insurance companies and financial institutions, in order to protect the legitimate rights of farmers effectively and promote the rural social stability and sustainable development.
