商标淡化理论新解:以关系为思考单元

摘　　要：以传统民法"权利本身受到侵害"的学说来解释商标淡化规则,只是一种描述性语言而非逻辑论证,难以获得理论上的证立和自洽。引入关系论作为淡化规则的分析工具和思考模型,能够为商标功能的演进和分化提供现实基础,特别是现在正处于超越生存而渐入生活的商业时代。将关系作为思考单元来计算强势商标权利,可以获得三重以上的复杂关系结构,进而形成自组织临界系统,淡化行为危害的最终结局正是商标关系系统的坍塌。淡化因此获得独立于传统侵权混淆理论的价值。相应地,淡化规则表现出一种可供操作的维护关系的力量,在中国化的过程中,显示了在行政及司法场合适用的对称性。It is just a descriptive language rather than a logical argument to interpret trademark dilution with the doctrine of＂rights are being violated＂ in traditional civil law, which can not be justified theoretically and self-consistent. Particularly in a commercial era of survival beyond life, introducing the doctrine of relation as analytical tool and approach will provide realistic basis for trademark evaluation and differentiation. Taking relation as thinking approach to count strong marks, there will be at least triple levels of relation structures, which form the self-organized critical system. Trademark dilution eventually results in the collapse of the system in which trademark relations are structured. Therefore, trademark dilution should be independent of traditional confusion as a cause of infringement. Accordingly, trademark dilution rules are operational in terms of maintaining the relations that a trademark represents and applicable to the administrative and judicial occasions of symmetry in the process of localization in China.
