摘　　要：我国新《刑事诉讼法》修改了有关刑事附带民事诉讼的相关内容,扩大了附带民事当事人的范围,增加了原告人申请财产保全措施,体现了立法对刑事附带民事诉讼制度的完善,但修法中规避的问题也值得我们进一步深入研究和探讨。China＇s new Code of Criminal Procedure modifies related content of the criminal incidental civil action, expands the range of incidental civil parties, and increases the property preservation measures for the plaintiff, reflecting the improvement of legislation on criminal inci- dental civil system. However , the problem which is circumvented in the amendment is also wor- thy of further study and exploration. The paper will talk about further improving the incidental civil action in combination with the provisions of an incidental civil action at home and abroad.
