试论美德层面上的政府正义

摘　　要：根据有无美德支撑,政府正义可分为非美德层面上的政府正义和美德层面上的政府正义两个层阶。美德层面上的政府正义呈复合型结构,包括内部结构和外部结构,前者涉及知、情、意三方面,后者关涉程序和实体的公正合理。美德层面上的政府正义具有三大特点:维系力量的内在性、效用发挥的稳固性和价值目标的向善性。According to the presence of virtue, government justice can be divided into the government justice exclusion of virtue and government justice supported by virtue. The latter has the complex structure, including the internal structure and external structure. The former is involved in cognition, emotion and meaning. The latter involves the Procedural justice and substantive justice. The government justice supported by virtue has three major characteristics, that is the internality of the maintain power, the soundness of the utility and value goal to goodness.
