某市医疗纠纷发生及诉前处理现状分析

摘　　要：目的调查2010年-2012年三年间昆山市医疗纠纷的发生、处理情况。探讨涉及纠纷诉前处理各方的地位作用及相互关系。方法汇总17家医疗机构2010年-2012年三年间的医疗纠纷发生、处理情况,分析三年来纠纷发生比例、处理方式之间的差异。结果三年间医疗纠纷的发生率无明显差异,分别为2.7‰,3.1‰和2.9‰。但医疗纠纷的处理途径发生了变化。三年间采用医患协商的比例分别为90.16%,82.17%和76.52%;采用医疗纠纷调解委员会(以下简称医调委)主持的第三方调解处理分别为9.29%、17.39%和19.84%;采用行政处理的分别为0、0.43%和2.02%;民事诉讼的比例分别为0、55%、0和1.62%。从医疗纠纷处理的途径上看,差异有统计学意义。结论三年来纠纷发生率并无明显变化,目前医患纠纷诉前处理主要有医患协商、行政处理、第三方调解三种方式。医患协商是纠纷处理的主要方式,第三方调解的作用日益突出,卫生行政部门在纠纷处理中仍有一定作用。Objective To clarify the status and relationships of all parties involved in the medical dispute before litigation, we investigated all the disputes occurred in Kunshan city from 2010 to 2012. Methods Collecting all the medical disputes occurred in 17 medical institutions from 2010 to 2012, we analyzed different ways of dealing with disputes. Results The incidence rate of medical disputes was not significant difference in the three years. From 2010 to 2012, it is 2.7%0, 3.1%o and 2.9%0, respectively. But the treatment way of medical dispute changed. In three years, the rate of doctor-patient consultation was 90.16%, 82.17% and 76. 52%, respectively. Medical dispute mediation committee （hereinafter referred to as the medical adjustable committee）, The third party mediation presided over the medical adjustable committee respectively 9.29%, 17.39% and 19.84% respectively. The rate of administrative handling was 0, 0.43 % and 2.02%, respectively. The rate of civil litigation was 0.55 %, 0 and 1.62%, respectively. There were significant differences of the way to deal with the medical dispute. Conclusion Three years of disputes rate did not change significantly, the current doctor-patient dispute before processing mainly to doctorpatient consultation, administrative processing, the third party mediation in three ways. Doctor-patient consultation is the main way of dealing with disputes, the third party mediation is playing an increasingly prominent role, the health administrative department still has a role in the dispute processing.
