摘 要:我国出于保证行政管理效率及其连续性、行政行为公定力理论及公共利益优先理论等方面的考量,采用行政诉讼不停止执行原则。但随着我国行政诉讼实践的开展和行政法学领域相关问题讨论的深入,理论和实践领域对我国行政诉讼中不停止执行原则的质疑之声越来越多。为了充分发挥行政诉讼的功能,确保公民权益保护的无漏洞性和有效性,我国应借《行政诉讼法》修改的契机,放弃不停止执行原则,改用停止执行原则。To guarantee the efficiency and continuity of administrative management,as well as to follow the presumed validity of administrative action theory and public interest theory, Chinese legislators adopt the principle of not stopping executing agency action in administrative litigation law. However, with the development of administrative litigation, an increasing number of scholars from both theory study and administrative litigation practice fields are questioning this principle. In order to give full play to the function of administrative litigation and to protect civil rights effectively in all directions, we should adopt the principle of stopping executing agency action when we revise the Administrative Litigation Law.
