摘　　要：目前,食品安全事故发生后对受害人的救济多适用民事赔偿、责任保险、社会保障等制度,但这些救济制度都存在一定的局限性,而补偿基金法律制度具有的公益性、补偿性、及时性等特性和功能,可以较好地解决在实践中受害人无法充分及时得到损害赔偿的问题。因此,应明确补偿基金支付申请的条件和补偿基金的支付范围,设计合理的补偿基金支付程序,确定补偿基金适用的序位,设置可行的补偿基金管理机构模式。At present, the victimg relief is suitable for civil compensation, liability insurance, social security system after the accident of food safety, but these relief systems also have some limitations. The legal system of compensa- tion fund has the public welfare, compensatory, timeliness properties. It can better solve the question of compensa- tion damages in practice. So it is necessary to make sure the condition of payment of compensation fund and range of compensation fund to pay. It can design compensation fund payment program and confirm the compensation fund.
