摘　　要：食品安全关系到人民群众的健康,也关系到国家的发展。食品安全问题的发生与不法之徒追求利益不无关系,这些生产者为了追求不法利益,置人民群众的生命健康于不顾,坑害群众。在这样的背景下,刑法作为人民群众健康的保护神,应该有所作为,发挥其应有的刑罚功能,以此来维护人民群众的健康和利益。Food safety is not only related to the health of the people, but also the progress of the country. The food safety accident has matter with the pursuit of interest of the illegal people who ignore the people＇ s health. Un- der this background, Criminal law should do something helpful and play the role of the penalty to protect the health and the interest of the people as the protector of the people.
