摘 要:《劳动争议调解仲裁法》的颁布实施在一定程度上规范了劳动争议仲裁及其相关制度,起到了一定的积极作用。但是,我国劳动争议仲裁制度在运行过程中也暴露出低效率、高成本、制度僵化以及缺乏衔接等诸多问题。解决这些问题需要改革"一调一裁两审"的劳动争议处理程序,让劳动争议仲裁回归ADR机制本源,加强队伍建设以及构建有衔接的仲裁诉讼机制等。The implementation of "Labor Dispute Mediation and Arbitration Law" regulated the labor dispute arbitration system to some extent and played a positive role.However,China’s labor dispute arbitration system during operation exposed inefficiency,high cost,system rigidity,lacking of convergence and many other issues.To solve these problems,we need reform the labor dispute handling procedure of "mediation,arbitration and then two trials".In addition,we should also let the labor dispute arbitration return to the origin of ADR mechanisms,strengthen the construction of the arbitrator,and build a reasonable convergence mechanism between arbitration and litigation.
