摘　　要：目前我国法律对于医疗机构告知义务的履行规定不够详细,对告知义务的内容、告知的形式与范围、什么是替代医疗方案、告知不全的界定及应承担的责任等都无明确规定。笔者通过调研,对医疗机构告知义务进行了深入的探讨。There is existing dual track system in medical damage expertise in China which can be described as the coexistences of medical negligence expert testimony led by each level of Medical Association and judicial expertise led by judicial administrative department.Based on the investigation and analysis of this problem,suggestions such as peer review,unified expertise procedure and content are presented.
