公立高校内部治理结构去行政化的法治路径

摘　　要：行政化为我国公立高校治理的基本特征。公立高校内部治理结构行政化主要表现为政治权力和行政权力主导化,学术权力边缘化与师生权力形式化,由政策治理向法治的跨越是我国高校去行政化改革推进的必然选择。当前,我国公立高校内部治理结构去行政化向法治化推进还存在一些障碍和问题。为推进高校去行政化改革,我国应针对公立高校内部治理结构行政化的表现及法律障碍而采取相应的法律对策。The administration is the basic characterization of governance in China public universities,which mainly expresses as the control of executive power and the political power,the marginalization of academic power,and the formalization of power between teachers and students.The transition that governed by the policy to the law is the inevitable choice of non-administration reform in China＇s colleges and universities.At present,there are still some obstacles and problems in propelling non-administration into legalization.Our country should aim at the administration performances of internal governance in public colleges and universities and legal barrier to take the legal countermeasures,in order to promote the non-administration reform in colleges and universities.
