摘　　要：学生评教已成为当前高校一项最基本的评价政策,但从目前国家现有立法来看并没有对于学生的评教行为做一个明确法律定性以及保护,本文主要对高校学生评教行为的权利性质进行分析,明确高校学生与学校之间的权利、义务在此基础上对高校学生评教行为的法律分析,明确高校学生评教权主体合法性以及权力行使范围的合法性,从法律的角度来保护高校学生的合法权利,以促使高校学生评教这个制度秩序化、合法化的发展。Most of the Universities think highly of the results of evaluating the education by their students, and the results has been become a very important role in the system of education-quality evaluating. So it is necessary that the working course of evaluation by students is controlled by some rules on who is the right-holder, how to exercise the right, what kind of responsibility needs taken, just in the moment that there are not such rules in legal by now, and which is the very point we are trying to take.
