摘 要:高校教师对学生教育的"惩戒权"和大学生对教师教学的"评教权"并存是一个长期存在却深刻影响高校教育质量,进而影响学生教育利益、教师职业发展及师生身心健康的关键问题。高校教师惩戒权与学生评教权应是平等主体间享有的正当权利。教师惩戒权须在教学过程中行使,对违规离开教学活动场所、违反基本教学规范、扰乱教学正常秩序、行为有违基本道德等行为的学生有权采取训斥、写检讨、扣分等惩戒措施,但惩戒权的使用应适度且合理,行使时应当尊重学生人格权;学生评教内容不能任意拓展,且应当尊重教师人格,当发生学生放弃评教的情形时,我们应该鼓励学生积极科学地参与评教,而不是利用其行政管理公权力强制学生参与评教。只有当这两种权利在冲突中不断寻求平衡时,才有利于推进我国教育事业的稳步向前。The interaction of teachers' disciplinary authority and educational evaluating by students is a long-standing factor that not only has profound influence on the higher education,but also affects students' education interests and teacher's vocational development as well as the sound development of body and mind.The rights of teachers' disciplinary authority and educational evaluating by students are individually enjoyed by the teachers and students equally in law.The teachers' disciplinary authority should be performed in the teaching process,and the disciplinary measures should be carried out to the students who leave the teaching environment violating the regulations,or disobey the basic teaching standard,or violate the teaching order and basic moral,such as scolding,self-examine and review,deducting scores and so on.But the disciplinary measures should be appropriate and reasonable,and respect the students' dignity.And the educational evaluating by students should not be expanded at will,also should respect teacher's dignity.When the students give up the educational evaluating right,they should be encouraged to participate the evaluating actively,and we should not force them to do it with the administration power.Only the balance is found in the conflicting of the two rights,our education can be promoted further.
