试析学生体育伤害事故的防范与处理

摘　　要：由于学生体育伤害事故频发以及学校在体育伤害事故中承担的责任过重,导致很多学校采取限制甚至是取消部分体育运动项目的消极措施。基于此,对体育伤害事故从责任主体以及发生原因进行分类,并从风险控制的角度,阐述学校应从哪些方面采取措施控制体育伤害事故发生的风险。最后提出应加强相关立法、构建更为合理的归责体系、建立国家赔偿责任体系完善对体育伤害事故的法律救济。Because of frequent sports injury accidents in schools and the overloaded responsibilities on the part of schools, many schools have adopted some negative measures to restrict or even cancel some sports events. Based on this, the paper classified sports injury accidents from liability subjects and reasons. It further explains how schools can control the risks of such injuries. Finally it proposes that the related legislation, reasonable imputation and state compen- sation system should be established so as to perfect the legal relief of such injuries.
