摘  要:目前,我国农民工劳动并未得到劳动合同法的有效保护,劳动不签约和违约现象普遍存在。基于广东农民工的问卷调查进行实证研究,结果表明:农民工劳动合约与人力资本专用性、流动性、工会组织、合约知识有着密切联系。给合约双方足够的合约激励与约束是有效推进农民工签订劳动合约的重要条件。最后基于劳动合同法,从提高农民工劳动合约制度的激励作用和增加违约成本两方面提出政策建议。The rural migrant workers (RMW) in China are now not effectively protected by the Labor Contract Law, and the phenomenon of failure to sign the contract and breach of the contract is very common. This paper makes an empirical research on the influencing factors by conducting a questionnaire survey in Guangdong. The results show that labor contracts of RMW are closely linked with the specificity of human capital, staff turnover, labour unions, and contractual knowledge. The sufficient contractual incentive and constraint on the parties to the contract is an important condition for effectively promoting RMW labor contracts. Finally, it puts forward some policy proposals for improving the incentive effect and increasing the penalty cost based on the Labor Contract Law.
