我国缺陷产品召回制度的构建——基于医疗器械召回管理的法经济学分析

摘　　要：运用法经济学分析我国已实施的医疗器械召回管理制度,发现召回管理制度将医疗器械生产企业确立为最低成本避免事故方,能够节约社会成本和提升企业效率。同时,召回管理有助于减少信息不对称现象并避免规制失灵。医疗器械召回管理的实施对建立我国缺陷产品召回制度具有重要的启发意义,即在确定合适的召回主体和召回模式的基础上,应该注重成本节约和收益提高并避免市场和规制的双重失灵。The paper makes a law and economics analysis and finds that the medical device recall system can reduce social costs and enhance corporate efficiency, and at the same time helps to reduce information asymmetries and avoid regulatory failures. The analysis proves that the recall system for medical devices is applicable, and the execution of the medical device recall management provides some enlightenment to the final establishment of China＇s recall system for defective products, namely, on the basis of ascertaining the appropriate recall subject and selecting the good recall mode, it is important to pay attention to cost saving and profit increase in order to improve efficiency, and to avoid the double failure of markets and regulations.
