强制医疗程序精神病鉴定意见认证障碍分析

摘　　要：法医精神病鉴定意见是强制医疗程序最核心的证据材料,直接决定强制医疗程序的运行结果。由于精神疾病医学特殊性质以及强制医疗程序设置等原因,致使法院在认证、采纳法医精神病鉴定意见时面临诸多障碍,对法院准确作出是否进行强制医疗的决定造成较大影响。在充分分析认证障碍基础上,为最大限度维护新刑诉法立法成果,结合实践提出针对法医精神病鉴定意见的认证标准及抗辩规则等两项特殊的认证规则。The Psychiatric evaluation is the core evidence in compulsory medical service procedure,which decided the procedure result.Due to the particular characteristics,courts face some barriers in identification,which lead to huge impact on judicial decision.On the basis of fully analyzing the identification barriers,and to maintain maximum legislative achievements,this article presents two rules which establish some standards in psychiatric evaluation identification and defense rules.
