清朝秋审与当前死刑复核程序的比较研究

摘　　要：秋审是我国历史上一项较为完备的死刑复议制度,清朝在明朝原有的基础上融入了时代特点加以完善并最终形成了具有自身特色的秋审制度。秋审对当前死刑复核程序仍然具有若干借鉴意义。Trial in Autumn was relative perfect system for reconsidering the death penalty case in the history. Basing on Ming Dynasty, reviewing death penalty case was improved in Qing Dynasty and developed a system of trial in Autumn with Epoch characteristics of epoch eventually. The paper is going to study on part of procedure of trial in Autumn and comparatively study on current reviewing system of death penalty. It is concluded that there are certain references to be taken from system of Autumn trial in Qing Dynasty by current death penalty reviewing system.
