农村祖坟山纠纷的法律应对

摘　　要：我国传统文化中有着浓厚的祖坟不可侵犯的观念。在农村家族墓地交给集体经济组织所有后,使得坟主后代对祖坟的权益受到严重的威胁,极易引发死人与活人争地以及坟主后代与承包经营权人争地的恶性群体性事件。由于国家并未对农村祖坟山上的利益进行过初始分配,一旦发生祖坟山纠纷,政府只能以调解或"和稀泥"方式加以解决,但效果有限。笔者认为在法律上应明确对祖坟山上的利益进行初始分配,认可坟主后代对祖坟的权益,限制集体土地所有权人和承包经营权人的权限,从而为农村祖坟山纠纷的解决提供充足的法律依据。In the traditional culture of our country, there has existed a strong idea that ancestry toms can never be violated. The author holds that in law we should make clear the initial distribution of inter- est of the tom hills, confirming the interests of the younger generations of the tom owners, limiting the right of the owner of the collective land and contactors dealing in the land so as to provide a sufficient le- gal ground to settle the disputes resulting from ancestry tom hills in the rural areas.
